Terms and Conditions
1 - Payment
Please contact us to receive a booking request form and check on provisional prices and availability. A non-refundable deposit of 20% of the total rental price is required within 1 week of confirmation of availability to secure the property. On receipt of the booking form and deposit we will send you a booking confirmation, which establishes our contract with you (see paragraph 15). You will be required to pay the balance, plus a £200 refundable security deposit, at least 6 weeks (42 days) before departure. For bookings which take place within 6 weeks of departure, the full amount will be required. If you fail to pay the balance when due, we will treat your booking as cancelled. For cancellation policy please see paragraph 5.
2 - Payment Methods
We accept *PayPal and *direct bank transfers. Payment details will be confirmed when the deposit or full payment is requested.
*You will be required to pay any charges resulting from transfers to ensure we receive the exact amount due.
3 - Prices
All prices given are in British Sterling (£). We reserve the right to increase/reduce the prices published prior to the time that you book your holiday. Any changes in price will be advised to you before you book the holiday.
4 - Amendments by you
If you wish to modify your booking, we will do our utmost to make the changes but modifications may be subject to price changes (if different price bands are involved) or cancellation charges. (Please see paragraph 5)
5 - Cancellation and fees
Cancellations must be made in writing/email from the person named on the booking request and will take effect the day such notice is received. Cancellation charges are as follows:
Rental deposit of 20%: non-refundable
Cancellations must be received by us in writing/email at least ONE WORKING DAY prior to the above day. Refunds due to you will be made by PayPal or cheque.
6 – Cancellation by Villa Baratz
In the unlikely event we have to cancel your booking we will refund all the monies paid by you, limited to the cost of the accommodation only.
7 - Responsibility
The descriptions on our web-site have been prepared in good faith. We cannot accept any liability in respect of injury, loss or damage however caused, unless it is by act or omission of our representatives. Any valuables are left at your own risk. Our liability to provide the service promised is limited to the value of the booking in all cases. Villa Baratz accepts no liability for events caused as a result of: acts of God, Governments, hostilities of war, political unrest, riot, civil strife, industrial dispute, natural or nuclear disaster, fire, theft, epidemics, quarantine, medical or customs regulations, technical or administrative problems with transport, closure of airports, breakdowns affecting machinery and equipment, adverse weather conditions, natural fauna, water, gas or electricity shortages or any other circumstances outside of our control which could not have been avoided even with all due care.
You are required to read and abide by any procedures contained in the 'Apartment Guide' sent to you on final booking confirmation.
8 - Complaints
In the unlikely event that you have any problem during your stay, you must report it immediately to Peter or Freda on 0044 (0)7752 463351. We shall attempt to resolve the matter as quickly as possible, but if you remain dissatisfied you must write to us within 14 days from the end of your holiday. A failure to notify us during the holiday may mean that we will be unable to resolve the issue after you return home.
9 – Arrival, departure and key collection
We will advise you in writing/email about arrival and departure times on your booking confirmation. Unless agreed otherwise, booking dates assume arrival after 16:00 p.m. and departure by 10:00 a.m. If these times are inconvenient for your flights we will do our best to be flexible, within the constraints of other bookings. Key collection arrangements will be confirmed before your scheduled departure time.
10 - Security deposit
A security deposit of £200 is paid by you on booking confirmation. The deposit will be returned to you as soon as possible after your departure on confirmation from our representative that all is in order and the keys have been returned as agreed. A deduction will be made for breakages, damage, excessive cleaning costs or lost keys. If in the unlikely event you cause damage which is over and above the amount paid for the security deposit, it will be your responsibility to cover the total cost of repairs.
11 - Care of property/Consideration of other guests
Please treat the property with utmost respect. It is also our own holiday home and you are expected to leave it in the same condition of cleanliness and repair as upon arrival. If there are guests in the other apartment please avoid loud noise, music, TV etc. after midnight. If you cause disturbance or annoyance you may be asked to leave. We shall have no responsibility to find alternative accommodation and no refund will be made.
12 - Insurance
Villa Baratz is covered by Public Liability and 3rd Party insurance. We strongly advise our guests to take out their own personal insurance in relation to travel, accident, medical and personal cover.
13 - Number of occupants
The total number of guests staying at the property may not exceed 6. The owners reserve the right to refuse entry or evict the entire party if the number of persons occupying a property exceeds the number stipulated in the contract.
14 - Data protection
All information provided to Villa Baratz will remain confidential and used only for client purposes.
15 - Contract
This contract is made on the terms of these Booking Conditions, which are governed by English law and the exclusive jurisdiction of the English courts.
